Trybunał Konstytucyjny orzekł, że niezgodne z konstytucją jest takie rozumienie ustawy o statusie sędziów TK, zgodnie z którym prezydent musi odebrać ślubowanie od osoby wybranej przez Sejm na sędziego trybunału. W pozostałej części TK umorzył sprawę.
