ETPC rozpatrywał skargę asesorów sądowych, którym ówczesny prezydent Lech Kaczyński odmówił w 2008 r. powołań na stanowiska sędziowskie. Skargę w tej sprawie złożyli Aleksandra Sobczyńska, Adrian Klepacz i Rafał Brukiewicz.
